The necessity of a special counsel to investigate the Department of Justice and FBI was clearly made in a March 6 letter by two Republican committee chairmen, Rep. Robert Goodlatte of Judiciary and Rep. Trey Gowdy of Oversight and Government Reform.
The letter, addressed to Attorney General Jeff Sessions, points out that there is an undeniable conflict of interest. The Department of Justice cannot be expected to impartially investigate itself. Furthermore, the Inspector General’s investigation, while helpful, suffers from legal limitations which prevent a complete and thorough search for the truth.
Goodlatte and Gowdy describe the problem at Justice and the FBI in these words. “There is evidence of bias, trending toward animus, among those charged with investigating serious cases. There is evidence political opposition research was used in court filings. There is evidence this political opposition research was neither vetted before it was used nor fully revealed to the relevant tribunal. Questions have arisen with the FISA process . . . .”
Can anyone doubt that the facts merit a special counsel?
We know that the FBI investigation into Hillary Clinton’s email scandal originally found her guilty of “gross negligence”, which is the exact wording of the legal definition for criminal handling of classified materials. But then Peter Strzok, known to be pro-Clinton and a Trump-hater of the highest magnitude, removed “gross negligence” from the report and Clinton was cleared. The Goodlatte-Gowdy letter includes the need for an investigation into “decisions to charge or not charge and whether those decisions were made consistent with the applicable facts.”
We know that the Trump “dossier”, containing allegations which have never been verified and in some cases have been disproved, was used to obtain a FISA warrant against Carter Page. The FISA court was not fully informed about the fact that this “dossier” had been paid for by the Clinton campaign and the Democratic National Committee, nor that a high-ranking FBI official had a conflict of interest since his wife worked for Fusion GPS as an expert on Russia.
We know that FBI officials discussed an “insurance policy” to be used in case of Trump’s election.
We know that those same FBI officials displayed a strong bias against Trump and in favor of Hillary Clinton, yet they were allowed to work on cases involving both.

He should not make the same mistake twice. Sessions should immediately appoint a special counsel, someone who can discover the truth about the actions of Justice and the FBI during the 2016 campaign and the Trump presidency.
Such an investigation will take time, and the findings may not be available until next year. That will allow the Democrats and their cheerleaders in the media to focus on unsubstantiated claims that the Mueller investigation is about to produce incriminating evidence against President Trump.
