Conservatives say that fairness requires that the full Senate be allowed to vote on the nomination of Judge Neil Gorsuch to the Supreme Court, according to a poll by FedUp PAC.
Failure to hold a vote would amount to overturning the results of the 2016 election, say 94% of those responding. The Republican majority in the Senate insisted on keeping open the vacancy produced last year by the death of Justice Antonin Scalia, saying that a nomination by the newly elected president would better represent the will of American voters. Polls show that many Trump voters were motivated by a desire to avoid a Supreme Court controlled by liberals.
Democrats have threatened to filibuster the Gorsuch nomination, which would require 60 votes to bring to an end. Since Republicans have only 52 senators, the support of eight Democrats would be required to overcome the filibuster. Forty-one Democrats could block the nomination, and do the same to anyone else Trump nominates. During Richard Nixon’s first term, when Democrats held a Senate majority, they defeated two conservative nominees for the Supreme Court and gave their approval only when Nixon selected the more liberal Harry Blackmun (later the author of the Roe v. Wade decision). Even without a majority, Democrats could use the filibuster in an attempt to force Trump to choose another Blackmun.
