The 2018 Senate elections could allow President Trump to Make America Great Again by remaking the Federal courts, appointing pro-Constitution judges who respect that great founding document.
Or the elections could lock in the left-wing judiciary dominated by appointees of Barack Obama and Bill Clinton, allowing them to handcuff President Trump at every turn.
You have seen the recent headlines about DACA and the Federal courts. First judges ordered Trump to continue renewing the DACA status of those who had previously signed up. Then another judge ordered Trump to start signing up still more illegal aliens, granting them immunity from the law.
In defense of Trump, Texas and six other states have now filed suit to have DACA declared unconstitutional – which it clearly is, lacking any basis in any law passed by Congress.
But the Constitution will not decide the issue – judges will. There can be no doubt that the many judges appointed by Obama and Clinton – who now dominate most of the nation’s courts of appeal – will insist on continuing DACA. Only the Supreme Court, where unreliable Justice Anthony Kennedy has the deciding vote, can overturn their rulings.
The good news is that President Trump has already made significant progress in filling judicial vacancies with constitutional conservatives. Not only did he put Neil Gorsuch on the Supreme Court, he has also added fifteen appeals court judges.
But that has only been possible because Republicans control the Senate, and by a very narrow 51-49 majority.
If Democrats win Senate control in November, that will be the end of Trump’s power to appoint judges who are faithful to the Constitution.
The Democrats will either refuse to confirm any Trump appointments, waiting and hoping for a Democratic president in 2021, or demand that he “compromise” by making nominations approved in advance by the Democrats. They will be Charles Schumer’s judges, not President Trump’s.
And meanwhile, Obama’s judges will overturn Trump’s policies, one after another.
We have already seen how those judges are determined to nullify Trump’s election, leaving it as if Obama were still president.
They stopped the implementation of Trump’s plan to protect us from terrorist immigrants.
They blocked his attempt to cut off some Federal funds to “sanctuary cities.”
They prevented him from keeping “transgenders” out of the military.
They required him to continue enforcing some of Obama’s environmental regulations.
They refused to allow implementation of his Executive Order protecting churches from the IRS.
They halted his pro-religious liberty changes to ObamaCare’s rules.
None of this will change until Trump is able to change the Appeals Courts, and ultimately the Supreme Court.
And that won’t happen unless Trump has a Senate majority to approve his nominations.
A safe majority will be especially vital if a Supreme Court vacancy opens up in the next two years, as it certainly could.
This could be the year that Republicans actually increase their majority, making it easy for conservative judges to be confirmed. There are several good opportunities to win Democratic seats.
Or it could be the year that Democrats win the power to shut down Trump’s appointments. They believe they can pick up at least four of the nine Republican seats on the ballot this year.
Democrats know that Federal judges are their best chance to force left-wing policies on Americans.
They can’t win a majority in Congress by honestly running as left-wingers. They have difficulty passing their legislation, and pay the penalty at the ballot box when they do.
But their Federal judges, with what usually amounts to a lifetime tenure, can overturn all the work of conservative Republican Presidents and Congressmen.
That’s why FedUp PAC needs to be exceptionally active in 2018. We must be sure that Americans, many of whom don’t pay close attention to the news, are fully aware of what is at stake in this election.
We must make them understand that a Democratic victory in 2018 is a victory for the most left-wing policies – government control of health care, gun bans, erosion of religious liberty, higher taxes, amnesty for illegal aliens, open borders, taxpayer-funded abortions, and regulations that kill economic growth and make energy more expensive.
