Elections still matter if you want a Supreme Court that faithfully follows the Constitution.
Don’t believe the hype claiming that Justice Kennedy’s resignation guarantees that a conservative majority is guaranteed for years to come regardless of the outcome of the 2018 and 2020 elections.
The truth is that a conservative Supreme Court depends on holding a Republican majority in the Senate, and probably also reelecting President Trump in 2020.
There is no guarantee that Trump’s nominee will be confirmed this year. Just one GOP defector could bring rejection and leave the seat open into next year – when Democrats hope to hold a Senate majority. That would allow them to vote down all Trump nominees unless he agrees to nominate someone chosen by the Democrats themselves. They would be happy to keep the seat open for the Democratic president they expect in 2021.
Even if the Senate confirms Trump’s nominee, the battle for a constitutionally conservative Court is not over. Chief Justice John Roberts could become the new Kennedy, swinging back and forth between left and right.
Or there could be another sudden death among the Court’s conservatives, like that of Antonin Scalia two years ago. There have also been rumors that Justice Thomas might soon resign.
The best guarantee of a conservative court is to have a dependable president and senate in place when one of the four liberal justices dies or resigns. That might not happen until President Trump’s second term.
Democrats are confident that they can take back the Senate this year and defeat President Trump in 2020. Their candidates are already lining up, eager for the chance to challenge the President.
They expect to be able to replace the aging liberal justices as they leave the Court, guaranteeing a liberal bloc of at least four justices for a generation – and needing to replace only one conservative to make those liberals a majority.
And if necessary, more and more Democrats are talking about reviving the FDR scheme of court-packing. They would create a liberal majority by adding more seats and filling each one with a liberal.
It could happen just that way if conservatives decide that we can take a victory lap and forget about the future – a future that will be shaped by November’s elections.
Think about what’s at stake if we lose the Senate first, and then the Supreme Court.
Freedom of speech and religious liberty will go down the drain.
Gun control, including bans on at least some types of guns, will be on the rise.
Attempts to control the border and deport illegal aliens will be overturned.
Anti-terrorism efforts will be struck down as “anti-Muslim”.
Criminals could be ordered released from prison to end the alleged inhumanity of “mass incarceration” being denounced by nearly all Democrats.
The Supreme Court might even discover a new “constitutional right” to a government payment (courtesy of the taxpayers) for those too lazy or undisciplined to hold a job (a guaranteed income is becoming the big issue among the Democratic left).
That nightmare could come true, but it doesn’t have to.
We can stop it, and that begins with maintaining and enlarging the Republican majority in the Senate. With a bigger majority, even a few Republican defectors could not block the next nominee.
